That is so not true, its imposible for MS to sue some guy just for buying a game!
They can sue the Kmart, but not the customer.
Every action he made was legel, he did not steal the game out of the shop did he ?
No he just asked if he could buy it already, and if a sales person from a stores tells him he can then he is lucky.

Halo 3 sticker that i am looking at RIGHT NOW states "Do not sell before 09/25/07"
meaning that is the basic sticker on every game that is shipped pre release date as according to microsoft

and Jared, seriously, remember 1 thing, you can see the dates on everything
achievements, last played, how long it was played, and that includes the next login time, even if you are offline

ya that is true this kid is just making it up the game has not even ship out to stores yet so there is now way he got it a 10 day ago. not even the people in India have it yet they have to wait until tomorrow to get it
